What Is This Lawsuit About?
Plaintiff Kristy Schwarm, on behalf of a class of California consumers, has sued District Attorney Technical Services, Ltd. (DATS) and its founder and president, Henry Craighead. The lawsuit alleges that these defendants violated the Fair Debt Collection Practices Act and deprived class members of rights guaranteed under the U.S. Constitution and other laws. The defendants operate in connection with the district attorney’s offices in more than two dozen counties in California.
Class members probably will not recognize the defendants’ names because the defendants' contacts with consumers were made in the name of a district attorney “Check Restitution/Prosecution” program. The demand letters said that the district attorney was investigating a criminal complaint and the consumer might be arrested if he or she did not pay various fees.
